TERMS AND CONDITIONS

1. The Promoter is BLUNDSTONE NEW ZEALAND LTD (NZBN 9 429 038 695 759) trading as JOHN BULL of 218 Swanson Road, Henderson, Auckland, New Zealand 0610, telephone 09 813 1730 (in New Zealand). (“Promoter”)

2. Information on how to enter and prizes of the giveaway promotion form part of these Terms and Conditions. Participation in this giveaway promotion is deemed as acceptance of these Terms and Conditions.

3. Entry is open to all residents of New Zealand over the age of 18 except employees and immediate families of the Promoter, and their associated companies and agencies. Immediate family includes the following: spouse, ex-spouse, de facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.

PROMOTIONAL PERIOD

4. The Promotional Period commences at 12:00am New Zealand Standard Time (NZST) on 01 May 2022 and closes at 11:59pm NZST on 30 June 2022 (“Promotional Period”).

PRIZES

5. Instant Prize: 23,918 John Bull Multi-tools to the total value of $95,000.00 (NZD)

6. Major Prizes: one of the following prizes, selected at random:
• Six (6) Air Hockey Machines each valued at RRP $799.00 (NZD)
• Six (6) Foosball Tables each valued at RRP $799.00 (NZD)
• Twenty (20) UE Boom 3 speakers each valued at RRP $279.00 (NZD)
• Fifty (50) John Bull Dartboards each valued at RRP $149.00 (NZD)

7. The total prize pool is valued at $117,618.00 (NZD)

8. Major Prizes include delivery to a registered New Zealand address between 9am-5pm NZST Monday to Friday, by a carrier nominated by the Promoter.

HOW TO ENTER

9. To enter, entrants must, during the Promotion Period, purchase a pair of John Bull footwear (excluding gumboots) from a participating retailer and receive a Scratch & Win Card.

DETERMINATION OF WINNERS

10. This is a game of chance determined at random by Scratch & Win Cards, and skill plays no part in determining the winners.

CLAIMING YOUR PRIZE

11. To claim your INSTANT PRIZE show your receipt and Scratch & Win Card to retail staff and receive your Instant Prize.

12. To claim your MAJOR PRIZE go online and follow the link on the Scratch & Win Card to a John Bull website and enter your name, address, email and phone number, the unique code provided on the Scratch & Win Card and upload a photo of your winning Scratch & Win Card, and receipt for the purchase referred to in Clause 5 above.

13. Major Prize Winners will be contacted directly via email or phone by 2:00pm on 07 July 2022 NZST to arrange for delivery of their Major Prize.

UNCLAIMED PRIZES

If any of the prizes remain unclaimed by 31 August -2022 the Promoter will conduct an unclaimed prize draw via the John Bull Facebook page.
The Promotional Period commences at 12noon on 1 September 2022 and closes at 11.59pm NZST on 8 September 2022 (“Promotional Period”).
Unclaimed Prize Draw Date: 12 noon (NZST) 9 September 2022.

Location of the Unclaimed Prize Draw:

To enter the unclaimed prize draw, complete each of these steps:
a) Entrants must be following the John Bull Footwear Facebook page @JohnBullFootwear and must continue to follow the John Bull page for the duration of this competition.
b) Entrants must like the dedicated Facebook post and tag a friend in the comments section of the post.
c) On 9 September 2022 at 12noon NZST John Bull Footwear will use a random generator to select the prize winner/s from the comments.
d) The winners will be contacted via direct message on Facebook by 16 September 2022.
e) John Bull will organise freight of prize directly to the winner address.

GENERAL COMPETITION TERMS AND CONDITIONS

14. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these Terms and Conditions. For the purposes of these Terms and Conditions content requirements, “entry content” includes any content (including text, photos, videos and Facebook messages) that entrants submit, upload, transmit, publish, communicate or use in connection with their entry into the Promotion. The Promoter may, in its absolute discretion and with reference to Clause 12, edit, modify, delete, remove or take-down any part of an entrant’s entry.

15. An entrant’s entry must not include:
a) any image or voice of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person
b) any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and
c) any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content (for example, recorded music) they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these Terms and Conditions.
The Promoter reserves the right, at their sole discretion, to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

16. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.

17. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

18. Independent financial advice should be sought as tax implications may arise as a result of accepting the prizes.

19. The prizes cannot be transferred, exchanged or redeemed for cash.

20. It is a condition of accepting the prize that the Winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the Winner to confirm such conditions with the prize supplier or other relevant third parties.

21. It is a condition of accepting the prize that the Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

22. All entrants agree that if they win the prize, they will not, and their companions will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including via the internet. Photographs will be allowed only at the discretion of the Promoter.

23. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

24. Incomplete or indecipherable entries will be deemed invalid.

25. In the event of war, terrorism, state of emergency, pandemic or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify the prize, subject to any written directions from a relevant regulatory authority.

26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
a. to disqualify any entrant; or
b. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the laws of New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of a prize.

29. The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize supplier and, as required, to New Zealand regulatory authorities.

30. Entry is conditional on providing this PI. The Promoter will also use, and handle PI as set out in the John Bull Website Privacy Policy, which can be viewed at www.johnbull.co.nz . In addition to any use that may be outlined in the Website Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages. The Website Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the privacy principles or any other applicable law and how those complaints will be dealt with.

31. The laws of New Zealand apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New Zealand.
